Scope:
• Four stories of apartments above grade level retail
• Attached restaurant
• Minimal off-street parking
Key Facts:
• Neighboring properties had encroached on land giving rise to prescriptive easement claims
• Complicated analysis was required to determine if structures and land could be partitioned into two “equivalent” shares and still meet zoning requirements
